General Terms and Conditions
§ 1 Scope of Application
These General Terms and Conditions (GTC) apply to all offers and contracts of Chauffeur Service Andreas Pech (hereinafter referred to as Limousine & Shuttle Service Frankfurt) with its customers (hereinafter referred to as the Customer).
§ 2 Offer and Conclusion of Contract
By ordering the service, the Customer submits a binding offer. Limousine & Shuttle Service Frankfurt may accept this offer within 30 days. Acceptance may be made in writing or by providing the service.
§ 3 Provision of services
Limousine & Shuttle Service Frankfurt shall not be liable for the impossibility of providing the service if this is caused by force majeure or other events that were not foreseeable at the time of conclusion of the contract. Limousine & Shuttle Service Frankfurt shall inform the customer of such circumstances immediately after becoming aware of them.
§ 4 Prices and terms of payment
The prices for the services are based on the currently valid price list of Limousine & Shuttle Service Frankfurt. Payment shall be made within 14 days of invoicing.
§ 5 Cancellation conditions
•10-6 days before provision: 25% of the booking
• 5-3 days before provision: 50% of the booking
• 48 hours before provision: 75% of the booking
• 24 hours before provision: 100% of the booking
§ 6 Customer's obligations to cooperate and prohibited use
The customer is obliged to accept the service at the agreed location and at the agreed time. If this does not happen, Limousine & Shuttle Service Frankfurt is entitled to provide the service at a later date or to charge for the additional costs incurred by the customer's delay.
Limousine & Shuttle Service Frankfurt's means of transport may not be used
for the transport of dangerous substances of any kind
for the commission of criminal offences
for journeys that exceed the contractual use
§ 7 Offsetting and right of retention
The customer shall only be entitled to offset if their counterclaims have been legally established or are undisputed.
§ 8 Reservation of changes
Limousine & Shuttle Service Frankfurt reserves the right to provide a different vehicle if the vehicle ordered is not available.
§ 9 Liability
Limousine & Shuttle Service Frankfurt is liable for damages resulting from intentional or grossly negligent behaviour on the part of Limousine & Shuttle Service Frankfurt or its legal representatives or vicarious agents.
In the case of damage resulting from simple negligence, the liability of Limousine & Shuttle Service Frankfurt is limited to typical and foreseeable damage.
The customer is liable without limitation for damage resulting from prohibited use within the meaning of § 6 (2).
§ 10 Creditworthiness and insolvency
Limousine & Shuttle Service Frankfurt is entitled to perform or provide outstanding services only against advance payment or security if, after conclusion of the contract, circumstances become known which are likely to significantly reduce the customer's creditworthiness.
In the event of the customer's insolvency, Limousine & Shuttle Service Frankfurt is entitled to withdraw from the contract.
§ 11 Severability clause
Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
§ 12 Text form
Amendments and additions to the contract must be made in text form.
§ 13 Place of jurisdiction
The place of jurisdiction is Frankfurt am Main.
§ 14 Choice of law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
